Terms of Service
The short version. This summary is for convenience only. The full Terms below are what apply.
- Feed Me helps you plan meals and track food. It is not medical advice, and its numbers are estimates.
- Never rely on Feed Me for an allergy, a medical condition or an eating disorder. Read labels, and talk to a qualified health professional.
- AI features can be wrong. You choose what to send them (apart from the coach tools described in section 5), and you should check what they tell you.
- Subscriptions are billed and managed by Apple or Google. A free trial becomes a paid subscription unless you cancel at least 24 hours before it ends.
- Your content stays yours. We use it to run the service for you.
- Coaches are independent people, not Feed Me. You choose whether to connect with one, and you can end it at any time.
- Nothing in these Terms takes away rights you have under consumer law that cannot be excluded.
1. About these Terms
1.1 Who we are. These Terms are an agreement between you and Envy Applications (ABN 95 927 268 876), a business based in Western Australia, Australia (“Feed Me”, “we”, “us” or “our”).
1.2 What they cover. These Terms apply to the Feed Me mobile app for iPhone and iPad and, when it is released, Android (the “App”), our website at www.feed-me-app.com (the “Website”) and everything we provide through them, including AI features, Pro subscriptions and coaching features (together, the “Service”).
1.3 Accepting these Terms. You accept these Terms when you create an account, tick the box asking you to agree, or use the Service. If you do not agree, do not use the Service.
1.4 Related documents. Our Privacy Policy and Consumer Health Data Privacy Notice explain how we handle personal information. Your app store’s terms (see section 20) also apply to downloading the App and to purchases made through the store.
1.5 Reading these Terms. Headings are for convenience. “Including” means “including without limitation”. A reference to “law” includes regulations and binding codes.
2. Eligibility and your account
2.1 Age. You must be at least 13 years old to use the Service. If the law where you live sets a higher minimum age to use an online service like this one (for example 16 in parts of the European Union), you must meet that higher age.
2.2 Under 18. If you are under 18 (or under the age of majority where you live), you may use the Service only if a parent or guardian has read these Terms and agrees to them and to your use of the Service. We recommend that you talk to a doctor or dietitian, together with your parent or guardian, before you set a weight goal or change how you eat (see section 4.2).
2.3 Capacity. You confirm that you are old enough, and have the legal capacity, to enter into this agreement.
2.4 Creating an account. You can sign in with an email address and password, with Google or with Apple. You must give us accurate information and keep it up to date.
2.5 Setting up before you register. While you set up the App, before you create an account, it signs you in to a temporary account so your answers can be saved. If you do not finish creating an account, that temporary account and its contents are deleted automatically after about two days. Features that use AI, and some others, need a registered account.
2.6 Keeping your account safe. You are responsible for your sign-in details and for activity on your account. One account is for one person: do not share it, sell it or transfer it. Tell us promptly at support@feed-me-app.com if you think someone else has used your account.
2.7 Deleting your account. You can delete your account at any time in the App (Me → Delete account) or by following the steps on our account deletion page. Deleting your account does not cancel a store subscription (see section 6).
3. Licence to use the App
3.1 Our licence to you. Subject to these Terms, we give you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices that you own or control, for your own personal, non-commercial use. Coaches may also use the App for their coaching as described in section 8.
3.2 What you must not do. Except where the law gives you a right that we cannot exclude, you must not:
- copy, modify, translate or create derivative works of the App;
- reverse engineer, decompile or try to extract the source code of the App or of our servers;
- remove or hide any proprietary notice;
- use the App to build a competing product or service;
- access the Service by automated means (bots, scrapers, scripts) or other than through the App and Website as we provide them;
- get around or interfere with technical limits or protections, including usage allowances, paywalls, any device-integrity checks we apply, and security features; or
- rent, lease, sell, sublicense or commercially exploit the App.
3.3 Updates. We may release updates. Some updates may be needed for the App to keep working, and older versions may stop working.
3.4 Open-source and third-party components. Parts of the App use open-source or third-party software and data that are licensed to you under their own terms. See the Acknowledgements at the end of these Terms.
3.5 Rights we keep. We and our licensors keep all rights in the Service that these Terms do not expressly give you.
4. Health, nutrition and safety
This section is important. Please read it.
4.1 Not medical advice. Feed Me is a planning and tracking tool for general information. It does not provide medical, dietetic or other professional advice, it does not diagnose, treat or prevent any condition, and it is not a medical device. Using Feed Me does not create a professional relationship between you and us.
4.2 Talk to a professional first. Check with a doctor or accredited dietitian before you change your diet, calorie intake or exercise, especially if you are pregnant or breastfeeding, under 18, older, living with a medical condition (such as diabetes or a heart, kidney or thyroid condition), taking medication, or have ever had an eating disorder or disordered eating.
4.3 Your targets are estimates. Daily calorie and nutrient targets are calculated from the information you enter using general formulas. They are a starting point, not a prescription. Individual needs vary, and you can change the targets. If you connect Apple Health or Health Connect, Feed Me may use the energy-burned figures from them to adjust what it shows; those adjustments are estimates too.
4.4 Nutrition information can be wrong. Calories and nutrients shown in Feed Me come from several sources: AI estimates from photos and descriptions, food databases, restaurant and manufacturer publications, product labels, and information you or other people have entered (including community databases such as Open Food Facts). Any of these can be inaccurate, incomplete, out of date or different in your country. Portion sizes are estimated. The printed label or the restaurant’s current information always prevails. We do not guarantee that any nutrition value is accurate.
4.5 Allergies, intolerances and dietary rules. Filters, “free-from” tags, “avoid” lists and ingredient information in Feed Me are convenience tools that are worked out automatically from the ingredient lists of recipes. Scans of barcodes, photos, labels and restaurant items are not checked against your avoid list, and the ingredient and additive notes on scanned products come from Open Food Facts data, which can be incomplete. They are not a guarantee or certification that a recipe or product is free from any allergen or suitable for any medical, religious or ethical diet (for example gluten-free, dairy-free, nut-free, vegan, halal or kosher). They can miss ingredients, and they cannot detect cross-contamination or changes to a recipe or product. If you have a food allergy or a medical dietary need, always check the label and the full ingredient list yourself, and ask the manufacturer or restaurant, before you eat.
4.6 Product scores and ingredient information. Product health scores, additive and ingredient notes and the sources shown with them are informational summaries based on published research and regulatory information. They reflect choices we have made about how to present and weigh that information, and the science and regulation can change or be contested. They are not medical advice and are not a recommendation that you eat or avoid any product.
4.7 Food safety. Recipes (including recipes you import or that AI suggests) may contain errors in quantities, cooking times, temperatures or storage advice. Use your own judgement and follow safe food-handling practices.
4.8 Eating disorders and body image. Tracking numbers can be unhelpful for some people. If tracking food, weight or goals in Feed Me makes you anxious, distressed or preoccupied, stop using those features and speak to a doctor or a qualified mental-health professional. Support is available from eating-disorder organisations in your country, for example the Butterfly Foundation in Australia (butterfly.org.au) and Beat in the United Kingdom (beateatingdisorders.org.uk). We cannot monitor your wellbeing.
4.9 Emergencies. Feed Me is not an emergency service. If you think you or someone else may be having a medical emergency or a reaction to food, contact your local emergency number immediately.
4.10 Connected health apps. If you connect Apple Health or Health Connect, the accuracy of that data depends on your device and the other apps and devices that write to it.
4.11 Website calculators and articles. Calculators, guides and articles on the Website are general information for healthy adults. They are not advice for you personally, and this section applies to them.
4.12 Your responsibility. You decide how to use the information in Feed Me. To the extent the law allows, you use it at your own risk and judgement.
5. AI features
5.1 What they are. Parts of the Service use artificial intelligence provided by third-party companies, including to estimate calories and nutrients from a photo or a description of a meal, read a nutrition label, import a recipe from a link, pasted text or a screenshot, suggest recipes, answer questions in the in-app assistant, turn your speech into text and, for Coaches, summarise or analyse the information a Client shares with them (together, the “AI Features”). Who our AI providers are, and what they receive, is explained in our Privacy Policy.
5.2 Your permission. The first time you use an AI Feature, the App asks for your permission to send the relevant content to our AI providers. If you say no, the AI Features that need it will not work, and the rest of the App still does. Sharing a link to Feed Me from another app’s share sheet on iPhone is your instruction to import it, and it is processed by our import providers without this prompt. If you are connected to a Coach, the Coach’s AI tools can process the information you share with that Coach without a separate prompt to you.
5.3 Outputs can be wrong. AI output can be inaccurate, incomplete, out of date, inconsistent from one request to the next, or unsuitable for you. AI may misidentify foods and portions, miss ingredients or allergens, or invent details. Check any output before you rely on it or save it to your log, and apply section 4.
5.4 What you send. Only send content that you have the right to send. Do not send other people’s personal information, content that is unlawful, or content designed to misuse the AI Features. A photo of a meal can capture people or documents in the background, so frame it carefully.
5.5 Your outputs. As between you and us, you may use the outputs the AI Features give you for your personal use. Because AI can produce similar outputs for different people, we cannot promise an output is unique.
5.6 Allowances and fair use. Free accounts have weekly allowances for AI Features, which are shown in the App and may change. Pro accounts have much higher allowances. Where a plan or a store listing describes AI Features as “unlimited”, that means no weekly cap for ordinary personal use: to keep the Service available and affordable for everyone, we also apply daily fair-use limits that are set well above ordinary use, to prevent automated, bulk or abusive use. We may change those limits, and we will only restrict use that is genuinely excessive.
5.7 No decisions about you. We do not use AI to make decisions about you that have legal or similarly significant effects.
5.8 Provider terms. Our AI providers’ own usage rules also limit how the AI Features may be used, and we may suspend use that breaches them.
6. Subscriptions, free trials and promo codes
6.1 Free and Pro. Feed Me is free to start. Feed Me Pro is a paid subscription that unlocks the features and allowances described in the App at the time you subscribe. What is included in each plan, and the free allowances, may change over time.
6.2 Plans and prices. Pro is offered on the billing periods (for example monthly or annual) shown in the App. The coaching tools for Coaches are part of Feed Me Pro (see section 8), and being coached is free. The price, the billing period and any free trial are shown on the purchase screen before you confirm, in your local currency and including any taxes the store adds.
6.3 Billing is handled by the store. Purchases are made through the Apple App Store or Google Play, not directly with us. Payment is charged to your Apple Account or Google account when you confirm the purchase. We never see your payment card details. The store’s terms govern billing, receipts, taxes and payment problems.
6.4 Automatic renewal. Subscriptions renew automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account is charged for the renewal within 24 hours before the end of the current period. You can manage or cancel your subscription at any time after purchase:
- iPhone and iPad: Settings → your name → Subscriptions, or use Apple’s subscriptions page.
- Android: Google Play → profile icon → Payments & subscriptions → Subscriptions, or use Google Play’s subscriptions page.
Cancelling stops future renewals. You keep Pro until the end of the period you have already paid for. Deleting the App or deleting your Feed Me account does not cancel a subscription.
6.5 Free trials and introductory offers. If a free trial or introductory price is offered, its length and terms are shown before you confirm. Unless you cancel at least 24 hours before the trial ends, it converts to a paid subscription at the price shown. Any unused part of a free trial is forfeited when you buy a subscription. Trials are generally limited to one per person and per store account, and we or the store may decline a trial to someone who has already had one.
6.6 Price changes. If the price of a subscription changes, the store will tell you and, where the store requires it, ask for your consent. A new price applies from your next renewal after the notice. If you do not agree, cancel before the renewal.
6.7 Refunds. Refund requests are handled by Apple or Google under their policies, so please contact the store first (on Apple, “Report a Problem” at reportaproblem.apple.com; on Google Play, your order history). Cancelling does not by itself refund the period you are already in. This section does not limit any right you have under consumer law (see section 16). If you are a consumer in the European Union or the United Kingdom, you may have a right to withdraw from a digital subscription within 14 days. When you ask for immediate access, you agree that we start supplying it right away and you acknowledge that you may lose the withdrawal right once the service has been fully provided, or lose the part of it that is proportionate to what has been provided.
6.8 Promo codes, offers and referrals.
- Feed Me promo codes, and referral codes that another user shares with you, give you Pro access for the period stated when you redeem them, such as a number of days or months, a year, or “lifetime”.
- “Lifetime” means for as long as we offer the Service and your account remains in good standing. It does not oblige us to keep offering the Service.
- Codes have no cash value, may not be sold, bought or traded, and may be limited to one per person or per account. They may expire.
- We may refuse, withdraw or reverse a code, or the access it gave, if it was obtained or used unfairly or in breach of these Terms (for example through fake accounts, referring yourself, or buying codes from third parties).
- When Pro access from a code ends, your account returns to the free plan unless you have subscribed.
- When you redeem a code from a friend, we may show you the name or label attached to that code so that you know who sent it.
- Offer codes issued by Apple or Google are governed by the store’s terms.
6.9 Changes to plans and features. We may add, change or remove features and plans. If a change materially reduces what you have paid for, we will tell you and you may cancel as described in section 6.4.
6.10 Restoring purchases. If you reinstall the App or change phones, you can restore your purchase through the App using the same store account.
7. Acceptable use
7.1 You must use the Service lawfully and fairly. You must not:
- break the law or infringe anyone’s rights, including copyright, privacy and publicity rights;
- upload or share content that is unlawful, defamatory, harassing, hateful, sexually explicit or harmful, or upload images of identifiable people without their lawful consent;
- impersonate another person or misrepresent your relationship with Feed Me;
- give us false information or abuse referral, trial or promo-code offers (for example by creating fake accounts);
- use the Service, including the AI Features, to produce harmful or unlawful content, or to build or train a competing AI model;
- scrape, harvest or bulk-copy our recipe library, nutrition data, scores or other content;
- upload malware, or probe, scan or test the security of the Service without our written permission; or
- interfere with the Service or with other people’s use of it.
7.2 Enforcement. If you breach this section we may remove content, limit features, suspend or end your account (see section 14) and, where the law requires or allows, report the matter to the authorities.
8. Coaching
8.1 What coaching in Feed Me is. Feed Me lets a person who coaches others on nutrition or fitness (a “Coach”) connect with a person they coach (a “Client”). A Client chooses whether to connect by sending a request using a Coach’s code, which the Coach then accepts, and can switch some sharing options on or off. Once connected, a Coach can see the information described in our Privacy Policy, set targets and goals, edit a meal plan, add recipes, assign habits, review check-ins and use AI tools, as shown in the App. Feed Me has no chat or direct-messaging feature between Coaches and Clients. Coaches can write feedback on check-ins and short notes with the targets they set, and Clients answer check-in questions in writing.
8.2 Coaches are independent. Coaches are independent third parties. We do not employ, supervise, vouch for or endorse any Coach, and we do not check a Coach’s identity, qualifications, registration or insurance. Any coaching arrangement, including any fee, is solely between the Coach and the Client, and is outside the Service. Feed Me is a software provider, not a health-care provider, and does not provide or take responsibility for coaching or advice. Treat a Coach’s guidance as you would any non-medical advice: check it with a doctor or dietitian where appropriate (see section 4).
8.3 Client control. A Client can end a coaching connection and turn off sharing at any time in the App. When a connection ends, the Coach’s access to the Client’s data in Feed Me stops. A Coach may already have exported or copied information while the connection was active, and what a Coach does with it is the Coach’s responsibility.
8.4 Coach responsibilities. If you use Feed Me as a Coach, you promise that you:
- have, and will keep, any qualifications, registrations, licences and insurance you need to coach in the places where you operate, and will not present yourself as a medical professional unless you are one;
- will use a Client’s information only to provide the coaching that Client has asked for, keep it confidential and secure, and not sell it, use it for marketing, or share it with anyone else without the Client’s permission, unless the law requires it;
- act as the person responsible for any Client information you export or keep outside Feed Me, and will comply with the privacy and health-information laws that apply to you;
- will delete Client information you hold when the coaching relationship ends, unless the law requires you to keep it;
- will not coach anyone under 18 unless you have a parent’s or guardian’s permission and meet any legal requirements for doing so; and
- will treat Clients respectfully and lawfully.
8.5 Coaching and Pro. Using the coaching tools as a Coach needs an active Feed Me Pro subscription or Pro code. If your Pro access ends, you keep read access to the Clients you already have, but you cannot accept new Clients or use the coaching AI tools. Being coached is free.
8.6 Our role and responsibility. To the extent the law allows, we are not responsible for what a Coach or a Client does, says or advises, or for the outcome of any coaching.
9. Your content and our content
9.1 Your content. Your recipes, meal plans, shopping lists, logs, measurements, photos, notes and other content you add to the Service (“Your Content”) stay yours. We do not claim ownership of Your Content.
9.2 Permission you give us. You give us a worldwide, royalty-free, non-exclusive licence to host, store, copy, process, format, compress, transmit and display Your Content, and to run the AI Features you ask for, only as needed to provide, secure, support and improve the Service for you and, where you choose, to show it to the people you choose (such as a Coach). This licence ends when you delete the content or your account, except for backups and copies the law requires us to keep, which are removed on the schedule in our Privacy Policy. We may use de-identified and aggregated information (which does not identify you) to understand how the Service is used. We do not sell Your Content.
9.3 What you promise. You promise that you have the rights needed to add Your Content and to give us this permission, and that Your Content (including any recipe or image you import or upload) does not infringe anyone’s rights or break the law.
9.4 Our content. The Service, including our recipe library, text, nutrition analysis, scores, designs, software and the Feed Me name and logo, belongs to us or our licensors and is protected by intellectual property laws. You may use it for your own personal, non-commercial use within the Service, and you may share individual recipes with friends and family using the sharing tools we provide. You may not otherwise copy, republish, sell or distribute it.
9.5 AI-created recipes and images. Recipes and recipe photos in our library were created with the help of AI tools. Photos are illustrations and may not look exactly like what you cook, and recipe details can contain mistakes (see section 4).
9.6 Sharing and exports. When you share a recipe, a progress image or an export (for example a PDF, a text summary or a spreadsheet of your food log), the file is created on your device and you choose who receives it. We cannot control what happens to a file once you have shared it, and exports can contain health-related information, so share them with care.
9.7 Third-party data. Some data in the Service comes from third parties and is licensed under its own terms. See the Acknowledgements.
9.8 Names and brands. Restaurant, brand and product names are used to identify the items they refer to and, in a few recipe titles, as dish names. Feed Me is not affiliated with or endorsed by them. Nutrition values for restaurant items come from what those businesses have published and may change.
9.9 Feedback. If you give us ideas or feedback, we may use them without restriction or payment.
9.10 Copyright complaints. If you believe content in the Service infringes your copyright, send a notice to support@feed-me-app.com with: a description of the work and where the material appears; your contact details; a statement that you believe in good faith that the use is not authorised; and your physical or electronic signature. We review valid notices and may remove the content or suspend the account responsible. If you think we removed something by mistake, tell us and we will review it.
10. Imported recipes and links
10.1 You can ask the App to import a recipe from a web page, a screenshot, pasted text, or a public post or video on platforms such as TikTok, Instagram, Facebook or YouTube. When you do, you instruct us to retrieve and process the public content at the link you give us (including, for a video, its audio, caption and cover image) and create a recipe in your account.
10.2 The content you import belongs to its creator or publisher. You are responsible for having the right to import and keep it, and for following the source’s own terms. Feed Me is not affiliated with those platforms or creators. We may keep a copy of public post information that we retrieved for import so it does not have to be processed again for the next person who imports the same post, as explained in our Privacy Policy. If you are a creator and want your content removed, email us.
11. Notifications and communications
11.1 Service messages. We may send you messages that are necessary for the Service, such as account, security, billing, trial and legal notices, and notices about coaching activity that involves you (for example that a Coach has updated your targets or reviewed a check-in).
11.2 Reminders. Meal and activity reminders are scheduled on your device and you control them in the App and in your device settings.
11.3 Marketing. We send product news and offers only if you have opted in, and you can opt out at any time in the App (Me → Notifications) or by using the unsubscribe link in any email.
12. Third-party services and links
The Service relies on third-party services, including Apple, Google, the app stores, our AI and speech providers, subscription, analytics, crash-reporting and advertising-measurement providers, and open databases. They are listed in our Privacy Policy. Their own terms apply to your use of their parts of the Service. We are not responsible for them, or for outages or changes to them, or for third-party websites and content we link to or import.
13. Changes, support and availability
13.1 Changes to the Service. We may add, change, suspend or discontinue features at any time. If we discontinue the Service as a whole, we will give reasonable notice and, where you have prepaid for a period we can no longer provide, we will refund the unused part where the law requires it or where we can arrange it through the store.
13.2 Availability. We aim to keep the Service available, but we do not promise it will be uninterrupted or error-free. We may carry out maintenance, and some features depend on third parties and your internet connection.
13.3 Support. Email support@feed-me-app.com. We will try to respond promptly.
13.4 Beta features. Features marked as beta or preview may change or be withdrawn.
14. Suspension and termination
14.1 By you. You can stop using the Service and delete your account at any time (see section 2.7). Cancel any subscription separately (see section 6.4).
14.2 By us. We may suspend or end your access if you materially or repeatedly breach these Terms, if we must do so to comply with the law, or to protect the Service, our systems or other people (for example in cases of fraud, abuse or security risk). Where it is reasonable and lawful we will tell you why and give you a chance to fix the problem first. If you think we have made a mistake, email support@feed-me-app.com and we will review it. We do not currently close accounts for being inactive. If we start to, we will give you notice first.
14.3 What happens next. Your licence to use the App ends. We handle your data as described in our Privacy Policy. Pro members can export their logged meals from within the App (Me → Export logged meals) before deleting their account. If we end your paid subscription without cause, we will refund the unused part of the period you paid for to the extent we can arrange it through the store.
14.4 Survival. The sections that by their nature should continue after termination do so, including sections 4, 9, 15 to 19 and 21.
15. Disclaimers
To the maximum extent the law permits, and subject to section 16:
- the Service is provided “as is” and “as available”;
- we do not promise that the Service, or any nutrition value, score, estimate, recipe or other information in it, is accurate, complete, current or suitable for you; and
- we exclude all warranties and conditions that are not expressly set out in these Terms, including any implied warranty of merchantability, fitness for a particular purpose and non-infringement.
16. Your consumer rights
16.1 Australia. Our services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the service. If the failure does not amount to a major failure, you are entitled to have the problem fixed in a reasonable time, and if it is not, to cancel and obtain a refund for the unused portion.
16.2 European Union and United Kingdom. If you are a consumer, you have mandatory rights under the law where you live, including that digital content and digital services must conform to the contract, and rights to a remedy if they do not. Nothing in these Terms limits those rights or our liability where the law does not allow us to limit it.
16.3 Other places. If the law where you live gives you consumer protections that cannot be waived, they continue to apply.
16.4 These Terms do not override those rights. Where a section of these Terms would, if applied, take away a right that cannot be excluded, it does not apply to that extent.
17. Limitation of liability
17.1 What is not limited. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded or limited by law, including under the Australian Consumer Law.
17.2 Consumers. Subject to section 17.1, and to the extent the law allows, we are not liable for loss or damage that was not reasonably foreseeable when you accepted these Terms, or for loss of profits, business or data caused by your use of the Service, and our total liability to you for all claims relating to the Service is limited to the greater of the amount you paid us (through the store) in the 12 months before the claim arose and AUD 100.
17.3 Businesses. If you use the Service in the course of a business, including as a Coach, then to the extent the law allows we are not liable for indirect or consequential loss or for loss of profits, revenue or data. For any guarantee that the law implies and allows us to limit, our liability is limited, at our option, to supplying the service again or paying the cost of having it supplied again. Our total liability for all claims is limited to the greater of what you paid us in the 12 months before the claim arose and AUD 100.
17.4 Health outcomes. To the extent the law allows, we are not liable for any health outcome, injury, allergic reaction or loss that results from your reliance on information in the Service in breach of section 4.
18. Indemnity
18.1 Coaches and businesses. If you use the Service as a Coach or in the course of a business, you will compensate us for loss, damage and reasonable costs from claims made against us by a third party that arise from your breach of these Terms, your coaching or advice, or your handling of a Client’s information.
18.2 Everyone else. If you deliberately or negligently breach sections 7 or 9 and we suffer loss as a result, you are responsible for that loss to the extent the law allows.
19. Governing law and disputes
19.1 These Terms are governed by the laws of Western Australia and the Commonwealth of Australia. Both you and we submit to the non-exclusive jurisdiction of the courts of Western Australia.
19.2 If you are a consumer, you may also bring a claim in the courts of the place where you live if the law there gives you that right, and mandatory consumer-protection laws of the place where you live continue to apply.
19.3 Before starting a formal dispute, please email support@feed-me-app.com and give us 30 days to try to resolve it. This does not stop you going to a court, regulator or ombudsman, or taking urgent action.
20. Apple and Google terms
20.1 If you got the App from the Apple App Store. This section applies in addition to the rest of these Terms.
- Acknowledgement. These Terms are between you and us only, not Apple. We, not Apple, are solely responsible for the App and its content. Your use of the App must also follow Apple’s Media Services Terms and Conditions.
- Scope of licence. The licence we give you is a non-transferable licence to use the App on Apple-branded products that you own or control, as permitted by Apple’s Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with the purchaser through Family Sharing or volume purchasing.
- Maintenance and support. We, not Apple, are solely responsible for providing maintenance and support. Apple has no obligation to provide any.
- Warranty. If the App fails to conform to any applicable warranty, you may tell Apple, and Apple will refund the purchase price (if any) of the App to you. To the maximum extent the law permits, Apple has no other warranty obligation for the App. Any other claim, loss, liability, damage, cost or expense attributable to a failure to conform to a warranty is our responsibility.
- Product claims. We, not Apple, are responsible for addressing any claims by you or a third party about the App or your use of it, including product liability claims, claims that the App fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws, including in connection with the App’s use of the HealthKit framework.
- Intellectual property claims. If a third party claims that the App or your use of it infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
- Legal compliance. You confirm that you are not located in a country subject to a US Government embargo or designated a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
- Developer details. Questions, complaints or claims about the App can be sent to: Envy Applications (ABN 95 927 268 876), Western Australia, Australia, support@feed-me-app.com.
- Third-party terms. You must follow any third-party terms that apply when you use the App, such as your mobile data agreement.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of this section and these Terms. When you accept these Terms, Apple has the right to enforce them against you as a third-party beneficiary.
20.2 If you got the App from Google Play. These Terms are between you and us. Google is not a party to them and is not responsible for the App or its content. Google Play’s terms of service also apply to your download and purchases.
20.3 Sanctions and exports. You must not use the Service if you are barred from doing so under applicable export-control or sanctions laws.
21. General
21.1 Whole agreement. These Terms are the whole agreement between you and us about the Service and replace earlier terms about it.
21.2 Notices. We may give you notices in the App, by email to the address on your account, or by posting on the Website. You may give us notice at support@feed-me-app.com.
21.3 Transfers. You may not transfer your rights or obligations under these Terms without our written consent. We may transfer ours to a successor of our business, and we will tell you if that happens.
21.4 If part is unenforceable. If a part of these Terms is found to be unenforceable, it is limited or removed to the minimum extent necessary and the rest stays in effect.
21.5 No waiver. If we do not enforce a right, that is not a waiver of it.
21.6 Events beyond our control. We are not liable for a failure or delay caused by events beyond our reasonable control, including outages of third-party services.
21.7 Language. These Terms are written in English. If we provide a translation, the English version prevails to the extent the law allows.
21.8 No third-party rights. Except for Apple under section 20, nobody else has the right to enforce these Terms.
22. Changes to these Terms
We may update these Terms. If a change is material, we will publish the updated Terms on our Website and, where we can, give you at least 30 days’ notice in the App or by email before it takes effect, unless the law or the security of the Service requires us to act sooner. If you continue to use the Service after the change takes effect, you accept the new Terms. If you do not accept a change, you can stop using the Service, delete your account and cancel your subscription before the change takes effect. The “Last updated” date above shows the latest version.

Feed Me uses data and software from others. This section gives the credits and licence notices they ask for. The same data sources are listed in the App under Me → Food data sources.
Open Food Facts. Product information for barcode scans (names, brands, ingredients, nutrition values, labels, additives and Nutri-Score data) comes from Open Food Facts, a community database. © Open Food Facts contributors. The database is available under the Open Database Licence (ODbL) 1.0, its individual contents under the Database Contents Licence (DbCL) 1.0, and its product images under a Creative Commons Attribution-ShareAlike (CC BY-SA) licence. Additive names and classifications in the App are derived in part from the Open Food Facts additives taxonomy. Open Food Facts data is contributed by the public, so always check the pack.
USDA FoodData Central. Nutrition values for many common foods come from FoodData Central (SR Legacy and FNDDS Survey), U.S. Department of Agriculture, Agricultural Research Service, which is in the public domain.
UK Composition of Foods Integrated Dataset (CoFID). Public Health England. Contains public sector information licensed under the Open Government Licence v3.0.
AUSNUT 2023. © Food Standards Australia New Zealand, licensed under CC BY 4.0. Some values have been calculated by us from the per-100 g figures it provides.
Restaurant nutrition information. Figures for restaurant items are what each restaurant has published for the country concerned, and each item links to its source. Restaurant, brand and product names are the trademarks of their owners and are used to identify the items and, in a few recipe titles, as dish names. Feed Me is not affiliated with or endorsed by them.
Nutri-Score. Nutri-Score is a trademark of Santé publique France. The Nutri-Score grades shown for scanned products come from Open Food Facts, and Feed Me’s own health score uses a points calculation that follows the published Nutri-Score method. Feed Me is not affiliated with or endorsed by Santé publique France.
Research and regulatory sources. Where the App cites a study or a regulator, the link goes to the original. The ratings and levels we show are our own editorial judgement, informed by those sources.
Fonts and icons. DM Sans and Lora are licensed under the SIL Open Font License 1.1. Icons are from Feather, licensed under the MIT licence, © Cole Bemis.
Open-source software. The App is built with open-source software licensed under the MIT, Apache 2.0, BSD, ISC and similar licences, and each belongs to its authors. To get the list of components and their licence texts, email support@feed-me-app.com.
If you think a source is not acknowledged properly, please tell us and we will fix it.
